Provision of assistance to a holding company which invoked the terms of the representations & warranties agreement signed between it and the seller of a target company acquired one year previously.
Once the relevant claims for compensation as provided in the representations & warranties agreement had been duly filed, the Litigation team specialized in corporate law issues commenced and successfully handled an arbitration procedure (in compliance with the arbitration clause set forth in the agreement) within a short deadline and had the seller condemned to pay more than € 600.000 in damages within less than one year.
In parallel and with a view to securing the solvency of the defendant, the team succeeded in having an attachment lien granted by the Presiding judge of the Tribunal de Commerce for provisional attachment of the seller’s bank accounts, which were subsequently garnished following the res judicata decision delivered by the arbitrators.
