The International law team has been providing assistance and counsel for many years to a world famous Austrian motorcycle manufacturer eager to ensure the sustainability of its commercial relations in France with distributors and customers.
In this respect, the work accomplished by the lawyers of the International law team is dedicated principally to the formation of contracts and general conditions of sale in compliance with contract law, distribution law and, if so required, collective procedure law and competition law in collaboration with the specialist teams in those fields.
The client’s standard contracts are governed by Austrian law and come under the jurisdiction of the Austrian courts. General monitoring procedures for the contracts i.e. contractual relationships and performance and dispute resolution/litigation are handled in German in consultation with the Chief council of the firm’s registered office in Austria which desires to preserve the layout of its contracts.
This process requires prior translation into French of the full set of documents drafted by the client, which must then be tailored to meet the French law and bolstered if possible by harmonized international texts such as the Vienna Convention, the UNIDROIT 2010 principles or the 2010 Incoterms.
